By accessing or using Have Your Cookie ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the modified terms.
You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

To use the App, you must create an account. You agree to:

The App includes photo capture functionality. By using this feature, you agree to use it exclusively for:
• Food images: Photos of meals, ingredients, or food items for nutrition tracking
• Progress pictures: Personal body progress photos for your own tracking purposes
Prohibited uses include but are not limited to:
• Uploading inappropriate, offensive, or illegal content
• Capturing images of other people without their consent
• Any use unrelated to nutrition tracking or personal progress
Violation of this policy may result in immediate account suspension or termination.
You agree not to:
• Use the App for any unlawful purpose
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Upload malicious code, viruses, or harmful content
• Use the App to send spam or unsolicited communications
• Reverse engineer, decompile, or disassemble the App
• Violate any applicable laws or regulations
We reserve the right to, at our sole discretion:
• Suspend or terminate your account for violations of these terms
• Delete accounts that engage in misuse of the App
• Ban users who repeatedly violate our policies
• Remove or disable access to content that violates these terms
In cases of serious violations, termination may occur without prior notice. You may appeal account actions by contacting us at friedrich@haveyourcookie.com.
All content, features, and functionality of the App—including but not limited to text, graphics, logos, icons, images, and software—are the exclusive property of Have Your Cookie and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.
The App is not a medical device and does not provide medical advice.
The nutrition tracking, calorie calculations, and any recommendations provided by the App are for informational purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment.

• Do not disregard professional medical advice based on information from the App
• If you have an eating disorder or a history of disordered eating, consult a healthcare professional before using this App
We are not liable for any health decisions you make based on the App's information.
We strive to provide reliable access to the App, but we do not guarantee uninterrupted availability.
• The App requires an active internet connection to function
• Service may be temporarily unavailable due to maintenance, updates, or technical issues
• We do not guarantee any specific uptime or availability
• Features may be modified, suspended, or discontinued at any time
We are not liable for any loss or inconvenience caused by service interruptions.
By using the App, you agree that we may use anonymized and aggregated data derived from your usage for the following purposes:
• Creating insights about nutrition tracking patterns and user progress
• Improving the App's features and recommendations
• Research and analysis to enhance the service
Your privacy is protected:
• No individual user will be named or identified
• No personal images will be shared without your explicit consent
• Data is aggregated in a way that prevents individual identification

If you are participating in our beta program, the following additional terms apply:
• Beta features are provided "as is" and may contain bugs or errors
• The beta program may be discontinued or converted to a paid subscription at any time
• When the beta period ends, you may be required to subscribe to continue using the App
What happens when beta ends:
• You will retain access to your existing account
• All your accumulated data and progress will be preserved
• You can continue using the App by subscribing to a paid plan
We will provide reasonable notice before any transition from free beta to paid service.
When paid features are available:
• Clear pricing information will be displayed before any purchase
• All prices include applicable taxes unless otherwise stated
• Subscriptions renew automatically unless cancelled
• You may cancel your subscription at any time through your account settings
Right to Cancel:
You have the right to cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period.
14-Day Withdrawal Right (EU Consumers)
Under EU law, you have the right to withdraw from a purchase within 14 days without giving any reason.
Exception for Digital Content:
By starting to use the App immediately after purchase, you acknowledge that:
• You expressly consent to immediate access to the digital content
• You understand that this waives your 14-day withdrawal right once the service has been fully provided
Refund Requests:
To request a refund or exercise your withdrawal right, contact us at friedrich@haveyourcookie.com within 14 days of purchase. Refunds will be processed using the same payment method used for the original transaction.
To the maximum extent permitted by applicable law:
• The App is provided "as is" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you.
Governing Law:
These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles.
Jurisdiction:
Any disputes arising from these terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany.
Informal Resolution:
Before initiating formal legal proceedings, we encourage you to contact us at friedrich@haveyourcookie.com to attempt to resolve any dispute informally.
